§ 1. General Clauses

1. This Privacy Policy sets out the rules for the processing and protection of personal data provided by Users in connection with the use of the 79wheels.com website (hereinafter referred to as the “Service”).

2. The controller of the personal data contained in the Service is FELGEO.PL Sp. z o.o. Sp. k., Tax Identification Number (NIP): 5993034046, REGON: 080223491, KRS: 0000690873, with its registered office in Kostrzyn nad Odrą, ul. Wyszyńskiego 34B.

3. The Controller may be contacted as follows:

  • by traditional mail to the registered office address indicated in point 2,
  • with regard to matters related to the protection of personal data, at the following email address: iodo@felgeo.pl.

4. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. (RODO).

§ 2. Purposes and legal bases for data processing

The Controller processes your personal data for the following purposes and on the basis of the following legal grounds:

1. Handling correspondence and inquiries (Contact Form, Email, Telephone)

  • Purpose: Responding to an inquiry submitted via the contact form, email message, or made during a telephone conversation.
  • Legal basis: Article 6(1) (f) of the GDPR (the legitimate interest of the Controller consisting in building relationships and providing responses). Where the contact aims at concluding a contract, the legal basis is Article 6(1)(b) of the GDPR (actions taken prior to entering into a contract). Where the contact aims at concluding a contract, the legal basis is Article 6(1) (b) of the GDPR (actions taken prior to entering into a contract).

2. Analytical and statistical purposes (Google Analytics)

  • Purpose: Analysis of website traffic statistics and user behavior in order to optimize the operation of the Service.
  • Legal basis: Article 6(1) (a) of the GDPR (the User’s consent expressed through cookie settings / the cookie banner).

3. Managing social media profiles

  • Purpose: Promoting the brand, informing about the Controller’s activities, and communicating with users via social media platforms (fan pages).
  • Legal basis: Article 6(1) (f) of the GDPR (the legitimate interest of the Controller).

4. Pursuing claims and defending against claims

  • Purpose: Archiving information in the event of a legal need to demonstrate facts.
  • Legal basis: Article 6(1) (f) of the GDPR (the legitimate interest of the Controller).

§ 3. Recipients of data

1. Users’ personal data may be transferred to entities whose services are used by the Controller in operating the Service:

  • providers of hosting and server services (data storage),
  • providers of IT systems (email service support),
  • entities providing technical support for the website,
  • provider of analytical services: Google Ireland Limited (for the purpose of website traffic analysis).

2. When social media platforms are used, the recipients of data also include the operators of such platforms (e.g. Meta Platforms Ireland Ltd., LinkedIn Ireland Unlimited Company).

3. All entities to which the Controller entrusts the processing of personal data guarantee the application of appropriate data protection and security measures

§ 4. Data retention periodOkres przechowywania danych

1. Data from correspondence (email, forms) shall be stored for the period necessary to provide explanations and conclude the matter.

2. In the event of entering into cooperation, the data shall be stored for the duration of the contract and for the period of limitation of claims.

3. Analytical data (Google Analytics) are stored for the period specified in Google tool settings (standardly 14 months or until cookies are deleted by the user).

§ 5. User rights

In accordance with the GDPR, the User has the right to access their personal data, to rectify them, to erase them (“the right to be forgotten”), to restrict processing, to object to processing, as well as the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing violates applicable regulations.

§ 6. Cookies

1. The website uses cookies. These are small text files sent by the web server and stored by the browser software on the user’s device.

2. Cookies are used for the following purposes:

  • Technical purposes: necessary for the proper functioning of the website.
  • Analytical purposes (Google Analytics): used to generate statistics that help understand how Users use the website, enabling improvements to its structure and content.

3. During the first visit to the website, the User may give consent to analytical cookies or refuse them.

§ 7. Analytical tools (Google Analytics)

1. The Controller uses the Google Analytics tool provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland).

2. This service consists of analyzing user behavior on the website (including time spent on the website, visited subpages, approximate location, and device type).

3. The Controller has enabled the IP address anonymization feature. This means that the user’s IP address is shortened by Google within the member states of the EEA before being stored, which prevents its direct identification.

4. In connection with the use of Google tools, user data may be transferred to Google servers located in the USA.

5. Google ensures an adequate level of data protection by applying mechanisms compliant with EU law (e.g. the Data Privacy Framework).

6. The User may block Google Analytics on all websites by installing the browser add-on provided by Google: https://tools.google.com/dlpage/gaoptout

§ 8. Social media profiles (Fan pages)

1. The Controller operates public profiles on social media platforms (e.g. Facebook, Instagram, LinkedIn), hereinafter referred to as “Fan pages”.

2. The personal data of Users visiting the Fan pages (including comments, likes, and online identifiers) are processed:

  • by the Controller: for the purpose of managing the profile, informing about brand activity, promoting services, and communicating with users (Article 6(1)(f) of the GDPR);
  • by the social media platform owner: under the terms set out in the privacy policy of the respective platform (including for marketing and analytical purposes).

3. With regard to statistical data concerning visits to the Fan pages, the Controller and the social media platform owner act as Joint Controllers.

4. The User voluntarily decides to follow the Fan page. At any time, the User may stop following the profile or delete their comments.

§ 9. Final provisions

1. The Controller applies technical and organizational measures ensuring the protection of processed personal data appropriate to the identified risks.

2. The Controller reserves the right to amend this Privacy Policy. The updated version will be published in the Service.
